Welcome to Speech and Language Games LLC (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your use of our mobile applications, including Score 4 Phonics and Score 4 Articulation (the “Apps”), and this website (collectively, the “Services”).

By accessing this website or downloading or using our Apps, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who May Use Our Services

Our Apps are educational tools designed to help children practice speech, language, and early literacy skills through engaging games.

While children may use the Apps under adult supervision, the Apps and this website are directed to parents, legal guardians, educators, and other adults for purposes of downloading, purchasing, and managing subscriptions. You must be at least 18 years old, or the age of majority in your jurisdiction, to agree to these Terms or make a purchase on behalf of a child.

If you are a parent or guardian permitting a child to use the Apps, you are responsible for supervising that use and for all activity and purchases associated with your Apple App Store or Google Play account.

2. Educational Purposes Only

Our Apps are designed to support learning and practice. They are not intended to diagnose, treat, cure, or prevent any medical condition, speech-language disorder, or learning disability.

Use of our Apps does not create a speech-language pathology, healthcare provider, therapist-client, or other professional relationship between you (or your child) and Speech and Language Games LLC or any of its owners, employees, or contributors.

If you have concerns about your child’s speech, language, reading, or overall development, please consult a qualified speech-language pathologist, physician, or other appropriate professional.

3. Privacy and Children’s Data

Your privacy, and your child’s privacy, are important to us. Our collection and use of information in connection with the Services, including information relating to children, are described in our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy before using the Services.

We comply with applicable children’s privacy laws, including the Children’s Online Privacy Protection Act (COPPA), with respect to any personal information collected through the Apps.

4. Purchases and Subscriptions

Some features are available only through an in-app purchase or subscription processed by Apple or Google.

Subscriptions automatically renew unless canceled through your Apple App Store or Google Play account before the renewal date.

Pricing, free trials, billing, cancellations, and refunds are governed by the policies of Apple or Google, as applicable.

Eligible purchases may be restored using the Restore Purchases feature within the App.

5. Acceptable Use

You agree not to:

• Copy, modify, distribute, or create derivative works from our Apps, website, or content without our permission.

• Reverse engineer, decompile, or attempt to extract source code from our Apps, except as permitted by applicable law.

• Use the Services for any unlawful purpose or in violation of these Terms.

• Interfere with, disrupt, or attempt to compromise the operation or security of the Services.

• Misrepresent your identity or age, or attempt to circumvent parental or age-related controls.

6. Intellectual Property

All content in our Apps and on this website, including but not limited to games, illustrations, graphics, audio recordings, word lists, activities, logos, software, and other materials, is the property of Speech and Language Games LLC or its licensors unless otherwise noted. This content is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, no right, title, or interest in the Services is transferred to you.

7. Availability and Changes to the Services

We strive to keep our Services available and functioning properly. However, we do not guarantee uninterrupted or error-free service and may update, modify, suspend, or discontinue any part of the Services at any time, with or without notice.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THEY WILL MEET YOUR OR YOUR CHILD’S INDIVIDUAL NEEDS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPEECH AND LANGUAGE GAMES LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE APP OR SUBSCRIPTION DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the foregoing limitations will apply only to the extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Speech and Language Games LLC and its owners, employees, contractors, and contributors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of the rights of any third party.

11. Discontinuation of the Services

You may stop using the Services at any time. We reserve the right to modify, suspend, or discontinue the Services, or any portion of them, at any time, with or without notice.

Sections of these Terms that by their nature should survive, including Sections 6 and 8 through 16, will remain in full force and effect.

12. App Store Terms

If you downloaded an App from the Apple App Store, you acknowledge that these Terms are between you and Speech and Language Games LLC only, and not Apple. Apple has no obligation to provide maintenance or support services for the App and is not responsible for any claims, warranties, maintenance, support, or other liability relating to the App. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

If you downloaded an App from Google Play, the same principles apply with respect to Google LLC.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.

You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.

14. General

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements relating to the Services.

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

We may update these Terms from time to time. Any updated version will be posted on this page with a revised Effective Date. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
